1. Evidence was sufficient to establish criminal sexual conduct in the first degree in violation of Minn. Stat. Â§ 609.342(e)(i) (1980); other conviction of criminal sexual conduct in the first degree under subsection (c) of the same statute, which was based on the same criminal act, is vacated pursuant to section 609.04, which forbids two convictions of the same offense (or of one offense and a lesser necessarily included offense) on the basis of the same criminal act. 2. Trial court did not prejudicially err in denying defense motion to prohibit use of prior conviction to impeach defendant when he testified.
